5 Years in Jail

Wed Mar 23, 2016 9:17 am

My friend's wife from NZ is in Immigration Detention now after serving 5 years in jail for stealing money from her employer. She has 4 kids and a husband here who are Australian Citizens.

She was told by her agent that she is almost certain to be released but I heard on the news that if you are in jail for more than a year you automatically get kicked out of Australia. Does she have any chance of staying here?

Your friend is in a difficult situation, and should consult a lawyer immediately. Once a person has received a conviction of more than 12 months, in most cases they can no longer fulfill the "character requirement", which is grounds for removal.

I wish you and your friend, and her children all the best.
